This privacy policy (“Privacy Policy”) describes the personal information, collected by WhosHere, Inc (“WhosHere”, “we”, “our” or “us”), including our affiliates and subsidiaries, how we collect that information, how that information may be used, and with whom it may be shared when you use our Services (as defined below).
References to “you” or “your” means the person accessing the Apps or using our Services.
This Privacy Policy applies to personal information collected by us or on our behalf, including information collected through our websites, your use of all platforms we provide, including the WhosHere™, the WhosHere Plus™ and NticeMe™ mobile applications (the “Apps”), via email, phone, or anywhere else we post this Privacy Policy (collectively, the “Services”). If you do not agree with this Privacy Policy, then you must not download, install, register with, access, visit or use the Services. By downloading, installing, registering with, accessing or using the Services, you agree to the terms and conditions of this Privacy Policy.

What information do we collect and how is it collected?
When we use the term “personal information”, we mean information that can be used to uniquely identify you (directly or indirectly).
We may collect information you provide to us in the following ways:
Registration. We collect registration information about you. In order to use some of our Services you may have to register and create an account, which involves providing personal information including your name, location information, e-mail address, phone number, password, gender, and date of birth.
Profile. When you create a profile on our Services, we will collect all information you provide to us including name, age, location information, gender, and any other personal information you choose to provide to us.
Other Interactions. We may collect personal information from you, including your name and email address, when you submit a message to us or when you use other forms on the Services. We may use this information to respond to you, send you additional information, or otherwise communicate with you.
We may also collect information that you choose to provide as Feedback (as defined below in “User feedback” section).
Payment information is collected and processed by our third-party payment provider.
We may also automatically collect certain personal information when you use the Services using cookies, pixels and similar tools as described below.
Cookies. A “cookie” is a small data file stored on your browser if you visit the Services. We use pixels and cookies to collect information such as your device type, browser type, and IP address. We also track content you visit on the Services and duration on specific pages of the Services to help us improve your access to the Services and enhance our Services. Cookies also enable us to track your general location and similar information that typically remains in aggregate form and does not identify you individually. If such information does identify you, we will treat it as personal information subject to this Privacy Policy. We may also use cookies or pixels to collect data with respect to confirmation that a message has been delivered to you, confirmation that you have read a message, and related information about our digital communications.
You can adjust your browser settings to disable or reject cookies but if you disable all cookies, you may be unable to access all functionality of the Services. We do not permit third parties to track your online activities over time and across other websites based on your use of the Services.
Log files. Like most online and mobile companies, we log the use of our Services. This includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks in order track aggregate movement, analyze trends, and gather broad demographic information for aggregate use. We collect this from anyone using the Services, including developers.
Analytics. The Services may also use analytics tools such as Google Analytics, a web analytics service provided by Google, Inc. that uses cookies to help us analyze how users navigate the Services. The information generated by this tool (including IP address) will be transmitted to and stored by Google in aggregate form and used to evaluate use of the Services, compile reports on Services activity and other services relating to Services usage. Location Information. We or our service providers may receive or infer information about your location from a variety of sources. For example, we may use your IP address to identify your general location or we may receive more precise location data from your mobile device (such as via GPS, wireless networks, cell towers, Wi-Fi access points). If you have enabled location information sharing while using the Apps actively, then your location information may be shared with our service provider in order to help you locate other users near you. We may use location data to analyze certain information, and to improve our Apps and Services and relevance of the information we provide to you via the Apps and Services. Please note that if you do not share your location information certain features of the Apps and Services will have very limited functionality.
How will we use your information?
In general, we use your personal information to accomplish our business and commercial purposes, including for marketing, and transactional purposes, or to otherwise enhance our business practices and our services to you. More specifically, we may use your personal information:
• To provide the Services to you (including to process registration with the Apps).
• To communicate with you and other individuals and to carry out your requests and respond to your communications.
• To carry out our obligations arising from any contracts entered into between you and us.
• To notify you about changes to the Services.
• To audit and monitor the use of the Services and to improve the quality of the Services.
• To manage comments, questions and requests.
• To provide you with information about the Services we offer in accordance with your preferences as indicated (this may include sending you other information about products or services of a promotional partner on that partner’s behalf), including any marketing consent preferences.
• To comply with any legal or regulatory obligations (including in connection with a court order and establishing, exercising or defending legal claims).
• To enforce or apply the agreements concerning you (including agreements between you and us and our terms, conditions, and policies).
How is my information shared?
When you supply any personal information, such as an e-mail address or phone number it may be shared with a service provider who has been hired by us to provide services to help us with our business activities such as product fulfillment, hosting, and follow-up information. These companies are authorized to use your personal information only as necessary to provide these services to us.
We reserve the right to transfer any information we have about you in connection with a sale, merger, consolidation, change in control, transfer of assets, reorganization or liquidation of our business. Your personal information can be shared freely by us across platforms owned by us. For example, information collected through WhosHere can be shared with WhosHere Plus and NticeMe, and vice versa.
We also reserve the right to disclose your information, including personal information, to third parties as we believe, in good faith, is appropriate or necessary to protect WhosHere and others from fraudulent, abusive, or unlawful uses or activity; to investigate and defend ourselves against any claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Services and our other property; to correct technical problems and malfunctions on the Services; or to protect the rights, property, or safety of us, our users, or other persons or entities. We may disclose your information, if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement activity or other legal process. If you use the Apps, your request will be transmitted via your mobile carrier’s network and your carrier may have access to it. Consult your carrier’s privacy policy for additional information.
What are my options?
You have a choice about whether or not you wish to receive information from us. We will not contact you for marketing purposes by email, telephone or text message unless you have given your prior consent. You can change your marketing preferences at any time by contacting us at help@nticeme.app.
You can update your registration information at any time by accessing your account.
Each of our Apps includes a function which allows you to delete your account within the App. If you elect to cancel your account at any time, you may choose the account deletion function within the App, in which event we will delete your account information (including phone number, profile information and account history) held in our production systems. (Some portions of your account data may be retained in our static archives, but no such archived information will be further used.) If you require assistance with that process, to cancel or delete your account you should contact us with your request at help@nticeme.app. When requesting assistance, please provide the phone number to which your account relates.
Please be aware that, following deletion of your account, you will need to create a new account if ever you wish to use the Apps again.
If you do not want to receive push notifications from us, you may opt out of receiving these when you first launch the App or at a later stage by using the settings on your mobile device.
You can choose whether or not to allow the Apps to collect and use real-time information about your device’s location through your device’s settings. You can manage these preferences when the App is first launched or at a later stage by using the setting on your mobile device. If you block the use of location information, some functionality on the App will be inaccessible and will not function properly.
Third party links, Applications, and Websites
The Services may contain links to third party websites or mobile applications that are not controlled by us. These links are made available to you as a convenience, and you agree to use these links at your own risk.
Please be aware that we are not responsible for the privacy practices or content of such third-party websites or applications. This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage, nor does it apply to your relationship with the third party websites, applications, services, and surveys that may be linked to, facilitated through or provided via our Services. This Privacy Policy only applies to information we collect from you while you are using the Services. If you navigate to a third-party website or application from the Services, we strongly encourage you to review and become familiar with that third-party website’s or mobile application’s own privacy policy and statements.
Security
We use reasonable precautions including technical, administrative, and physical procedures, to protect personal information from loss, misuse, or alteration. Although guaranteed security does not exist on the Internet or offline, we make commercially reasonable efforts to handle such information consistent with this Privacy Policy and applicable laws. Due to the design of the Internet and other factors outside our control, we cannot guarantee that communications between you and our servers will be free from unauthorized access by third parties. Any information, including personal information, you provide to us via the Internet is at your own risk. Where will we transfer your information?
We are headquartered in the United States and we will process your information in the United States. By using our Services, you acknowledge and agree that your personal information may be transferred and stored in the United States.
If we transfer your information outside of the European Economic Area (“EEA”), Switzerland, or the United Kingdom (“UK”), we will take reasonable steps and implement appropriate measures to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this Privacy Policy and in accordance with data protection law.
Notice to Individuals in the EEA, Switzerland, or UK
This section only applies to individuals in the EEA, Switzerland, or the UK.
WhosHere, Inc. is the data controller for users of the Services and we determine the purposes for which your personal information is used and how we use your personal information.
Legal Bases. Certain laws, including the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”) require that we inform you of the legal bases for our processing of your personal information. We process personal information for the following legal bases:

Performance of a contract: information processing is necessary to perform a contract with you or take steps to enter into a contract at your request, such as providing access to our Apps;

The majority of any information processing referenced in this Privacy Policy is based on a legitimate interest. In all cases where legitimate interests are relied upon as a lawful basis, we take steps to ensure that our legitimate interests are not outweighed by any prejudice to your rights and freedoms. This is achieved in a number of ways, including the application of principles of data minimization and security, and taking steps to ensure that information is collected where it is relevant and for lawful business activities, and that it is reasonably necessary for those activities.

Data Retention. We will retain your personal for as long as is necessary for purposes for which it was collected. The precise period will depend on the reason why it was collected. Those periods are also based on the requirements of applicable laws, applicable legal and regulatory requirements, and periods relating to the commencement of legal actions.
Your GDPR Rights. The following is a summary of the data protection rights available to individuals in the EEA, Switzerland, and UK with respect to their personal information. The rights may only apply in certain circumstances and are subject to certain exemptions. Please see below for a summary of your rights. Summary of your rights

Right of access to your personal information. You have the right to receive a copy of your personal information that we hold about you, subject to certain exemptions.

Right to rectify your personal information. You have the right to ask us to correct your personal information that we hold where it is incorrect or incomplete.

Right to erasure of your personal information. You have the right to ask that your personal information be deleted in certain circumstances. For example (i) where your personal information is no longer necessary in relation to the purposes for which they were collected or otherwise used; (ii) if you withdraw your consent and there is no other legal ground for which we rely on for the continued use of your personal information; (iii) if you object to the use of your personal information (as set out below); (iv) if we have used your personal information unlawfully; or (v) if your personal information needs to be erased to comply with a legal obligation.

For example (i) where you think your personal information is inaccurate and only for such period to enable us to verify the accuracy of your personal information; (ii) the use of your personal information is unlawful and you oppose the erasure of your personal information and request that it is suspended instead; (iii) we no longer need your personal information, but your personal information is required by you for the establishment, exercise or defense of legal claims; or (iv) you have objected to the use of your personal information and we are verifying whether our grounds for the use of your personal information override your objection.

Right to object to the use of your personal information. You have the right to object to the use of your personal information in certain circumstances. For example (i) where you have grounds relating to your particular situation and we use your personal information for our legitimate interests (or those of a third party); and (ii) if you object to the use of your personal information for direct marketing purposes.

You have the right to obtain your personal information in a structured, commonly used and machine-readable format and for it to be transferred to another organization, where it is technically feasible. The right only applies where the use of your personal information is based on your consent or for the performance of a contract, and when the use of your personal information is carried out by automated (i.e., electronic) means.

Right to withdraw consent. You have the right to withdraw your consent at any time where we rely on consent to use your personal information.

The information in this section only applies to California residents. This section describes how we collect, use, disclose, share, sell, and otherwise process personal information of individual residents of the State of California within the scope of the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CCPA”). You can contact us if you have any questions about this Privacy Policy, including this section specific to California residents. How We Collect and Use Personal Information
As described in the “How will we use your information?” section, we share personal information with our other Apps and our service providers that help us operate our Services and business. We may also share personal information with a variety of third parties, including for marketing purposes; if we are subject to corporate transactions or reorganizations; with third parties to comply with law or to protect our rights or the rights and safety of others; or for purposes otherwise disclosed or for which you have consented. For the purposes of this section, when we use the term “third party,” we mean entities that are not service providers providing services on behalf of us and that are not entities with whom you interact with directly.
The table below describes each of the categories of personal information we collected about the California residents in the last 12 months and disclosed it for a business purpose, and the categories of third parties with whom we shared that information.
We do not use or disclose Sensitive Personal Information outside of the permitted purposes set forth under Section 7027(m) of the California Consumer Privacy Act Regulations.
Sources of Personal Information
As described in the “What information do we collect and how is it collected?” section above, we collect personal information directly from you when you provide it to us and automatically using cookies and other tracking technologies.
Purposes for Collecting Personal Information
We collect, use, sell, share for cross-context behavioral advertising, or disclose personal information about you for the business and commercial purposes further described in “How will we use your information?” section above.
Retention of Personal Information
We will retain your personal information for as long as is necessary for purposes for which it was collected. The precise period will depend on the reason why it was collected. Those periods are also based on the requirements of applicable laws, applicable legal and regulatory requirements, and periods relating to the commencement of legal actions.
Your Rights and How to Exercise Them
California residents have certain rights under the CCPA. Those rights may only apply in certain circumstances and may be subject to limitations or exceptions. A summary of those rights is provided below as well as information on how to exercise your rights. Please note that we will require certain identifying information about you as necessary for us to verify your request in accordance with applicable law.

Right to Request Deletion. The right to request us to delete the personal information we collect or maintain about you. Please note that certain exceptions may apply to your right to delete information, such as when we must retain your information to comply with law. Right to Non-Discrimination. You have the right not to receive discriminatory treatment by us for exercising any of your rights under the CCPA. However, we may offer certain financial incentives, charge reasonable fees related to your requests, or deny your right to know, right to opt out of sale or right to deletion in accordance with applicable law.

Right to Opt Out of Data Sales or Sharing for Cross-Context Behavioral Advertising. The right to direct us to not sell or share personal information we have collected about you to third parties, including for ad targeting / cross-contextual advertising.

Right to Limit the Use of Sensitive Personal Information. The right to limit the use or disclosure of your sensitive personal information if we use or disclose sensitive personal information for reasons other than those set forth in Section 7027(m) of the California Consumer Privacy Act Regulations.

California’s “Shine the Light” Law. California’s “Shine the Light” law (Civil Code § 1798.83) also permits California residents that have an established business relationship with us to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year or to have the right to opt-out of such disclosures. We do not currently share any personal information with third parties for direct marketing purposes by such parties.
How to Submit a Request to Know, Access/Data Portability, Correct, or Request to Delete
If you are a California resident and would like to make such a request, please email us at help@nticeme.app and insert “California Privacy Rights Request” in the subject line. Please note that we may require certain identifying information about you when necessary to verify your request in accordance with applicable law, which may vary depending on the Services you are using. In order to verify your identity, we will generally require either the successful authentication of your account, or the matching of sufficient information you provide us to the information we maintain about you in our systems. Please provide your [name, email address, and phone number] in the original request, as well as an explanation of the rights you wish to exercise. We will only use the personal information provided in connection with a rights request to review and comply with the request. If you do not provide this information, we may not be able to verify or complete your request in all circumstances.
If you wish to submit a verifiable consumer request on behalf of another individual, we will also need sufficient information to verify that the individual is the person about whom we collected personal information and that you are authorized to submit the request on their behalf. Please see the “Authorized Agents” section below for more information.
In certain circumstances, we may decline a request to exercise the rights described above, in accordance with applicable law.

However, we may ask you to provide additional personal information (including your [name, email address and phone number]) so that we can properly identify you in our dataset to facilitate the opt-out request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems.

Personal Information of Children Under Age 16
We do not sell or share personal information of consumers we know to be less than 16 years of age.
Authorized Agents
In certain circumstances, you are permitted to use an “authorized agent” (as that term is defined by the CCPA) to submit CCPA requests on your behalf. We may verify the authorized agent’s authority to act on your behalf as follows:

For requests to know, access, correct or delete personal information, we may ask you to provide sufficient evidence to show that you have provided the authorized agent signed permission to act on your behalf, verified your own identity directly with us pursuant to the instructions set forth in this Privacy Policy, and directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.

For requests to opt-out of personal information “sales” or “sharing” for cross-contextual advertising of personal information we may ask you to provide a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf.
Nondiscrimination
We do not discriminate against you for requesting any of the rights noted above. We are permitted to deny or limit your request in accordance with applicable laws.
Do-not-track disclosure; third-party tracking
Certain mechanisms may allow you to send web browser signals, known as “Do Not Track” (“DNT”) signals, indicating your choice to disable tracking on the Services. While we continue to explore this evolving technology, our websites does not respond to browser-based DNT signals at this time. We may not be aware of or able to honor and respond to every such mechanism. More information about “do not track” is available at www.allaboutdnt.org concerning such information.
Third parties, other than our vendors (such as our website analytics provider), do not have authorization from us to track which websites you visited prior to and after visiting the Site. That said, we cannot control third party tracking and there may be some third-party tracking that occurs without our knowledge or consent.
Notice to Virginia residents
The information in this section only applies to Virginia residents. This section describes how we collect, use, disclose, share, sell, and otherwise process personal information of individual residents of the Commonwealth of Virginia within the scope of the Virginia Consumer Data Protection Act of 2021 (“VCDPA”). When we use the term “personal data” in this section, we mean “personal information” as defined in this Privacy Policy.
We process the categories of personal data described in the “What information do we collect and how is it collected?” section above and as shown in the table below.
As described in the “How will we use your information?” section, we share personal information with our other Apps and our service providers that help us operate our Services and business. We may also share personal information with a variety of third parties, including for marketing purposes; if we are subject to corporate transactions or reorganizations; with third parties to comply with law or to protect our rights or the rights and safety of others; or for purposes otherwise disclosed or for which you have consented. For the purposes of this section, when we use the term “third party,” we mean entities that are not service providers providing services on behalf of us and that are not entities with whom you interact with directly.
We sell personal data and process it for targeted advertising purposes. Targeted advertising means when we display advertisements to you based on information we obtain about you through nonaffiliated websites or online applications to predict your interests. Please see your rights to opt out from these activities listed below.
We process personal data for different purposes, depending on how you interact with the Apps and Services. We process personal data about you for the purposes described in “How will we use your information?” section above.
Your Rights and How to Exercise Them
As a Virginia resident, you may be able to exercise the following rights in relation to the personal data that we have collected about you (subject to certain limitations at law):

Please note that we may require certain identifying information about you when necessary to verify your request in accordance with applicable law, which may vary depending on the Services you are using. In order to verify your identity, we will generally require either the successful authentication of your account, or the matching of sufficient information you provide us to the information we maintain about you in our systems. Please provide your [name, email address, and phone number] in the original request, as well as an explanation of the rights you wish to exercise. We will only use the personal information provided in connection with a rights request to review and comply with the request. If you do not provide this information, we may not be able to verify or complete your request in all circumstances.

Sensitive Data and Personal Data of Children Under Age 13
We will only process your Sensitive Data in accordance with applicable law, including obtaining your consent prior to processing. We do not process personal data of consumers we know to be less than 13 years of age.
Children
Our Services are not designed nor intended for use by children under the age of 18. We do not knowingly solicit, collect or keep personal information from anyone under the age of 18. If we discover that we have inadvertently gathered any such information for a child under 18, we will take appropriate steps to delete it.
